Terms & Conditions

–Artist: Izet Oosting - Hummel (Art & Acrylics), based in Provincie Groningen, registered under Chamber of Commerce number 83279474.

–Client: The natural person (consumer) or legal entity (business) who commissions a work or purchases an artwork.

–Artwork: All unique paintings, woodburning works, wooden products, designs and sketches produced by the Artist.

–These terms apply to all offers, quotations and agreements with the Artist.

–All quotations from the Artist are without obligation and valid for 30 days.

–Deviations from these terms are only valid if they have been recorded in writing.

–The Artist retains full copyright and all intellectual property rights to the Artwork at all times.

–The Client buys the physical Artwork, not the copyright.

–The Client is not permitted to duplicate, reproduce, digitally scan or commercially exploit the painting or woodburning work (such as selling prints) without prior written permission.

–The Artist has the right to use images of the Artwork for their own promotion, portfolio, social media and publications, including after sale.

–The Client may not alter, overpaint, modify with burning tools, or remove the name/signature of the Artist.

–A commission is established after written approval (by e-mail or via a signed quotation) by the Client.

–For woodburning work, the Client provides any specific texts, photos or logos in good time. The Client is responsible for the copyright of supplied visual material.

–The Artist has artistic freedom in carrying out the commission, within the previously discussed frameworks and style.

–As this concerns handwork, small deviations in colour, texture and wood grain compared to a possible digital design or sample photo may occur.

–The estimated delivery time for custom work is approximately 5-10 weeks after approval of the commission, unless otherwise agreed in writing.

–Delivery times are indicative. Exceeding the term does not entitle the Client to compensation or dissolution of the agreement.

–Prices and shipping costs: All stated prices for Artworks exclude shipping costs, unless expressly stated otherwise in writing.

–Advance payment: The Artist only starts executing a commission (custom work) or preparing shipment (existing work) after full payment has been received by the Artist.

–Invoice validity: Invoices must be paid within 14 days of the invoice date. If payment is not received within this term, the reservation of the Artwork or the slot in the production planning lapses.

–Shift in delivery time: The indicative delivery time of approximately 5-10 weeks (as stated in Article 4) only starts on the day the payment is fully credited to the Artist's bank account.

–Retention of title: All Artworks remain the full property of the Artist until the Client has met all payment obligations.

–Wood is a natural product. The Client accepts that wood may move under the influence of humidity and temperature (slight warping, expansion or shrinkage). This is a natural characteristic and not a production fault.

–The Client must protect the Artwork (both painting and woodburning work) against prolonged direct sunlight, extreme heat, moisture and outdoor conditions, unless it has been agreed in writing that the work is suitable for outdoor use.

–The Artist is not responsible for the natural discolouration process of wood or paint due to exposure to UV light.

–Mandatory shipping method: To protect both parties, Artworks are shipped exclusively via an insured shipping method from PostNL, DHL or another professional postal company. This shipping method and the associated costs are non-negotiable.

–Risk: The risk of loss, theft or damage during transport lies with the Artist until the moment of delivery to the Client, provided the mandatory insured shipping has been used.

–Reporting damage: Visible transport damage or defects must be reported to the Artist in writing and with clear photographic evidence within 48 hours of receipt, so that the Artist can file the damage claim with the postal company.

–Custom work (commissions): Cannot be cancelled or returned after work has started. In the event of interim cancellation by the Client, the Client is obliged to fully reimburse the hours already spent and material costs.

–Existing work (open sale): Private consumers have a statutory reflection period of 14 days for an online purchase. This right does not apply to business clients. Return costs are borne by the Client. The work must be returned in its original, undamaged condition.

–Risk on return: The Client is responsible for safe and proper packaging of the return shipment. The risk of damage or loss during return transport lies entirely with the Client. If the Artwork arrives at the Artist damaged or with signs of use, the reduction in value (up to 100% of the purchase price) will be deducted from the refund.

–The Artist is not liable for damage caused by incorrect maintenance, incorrect use, or incorrect/unsafe hanging or placement of the Artwork.

–The total liability of the Artist is always limited to a maximum of the amount the Client paid for that specific Artwork.

–All agreements are governed exclusively by Dutch law.

–Disputes will be submitted to the competent court in the Artist's region.
